Caracterización del modus operandi de delincuentes sexuales online con menores de edad

Resumen

En los primeros nueve meses del año 2023, un 44 % de las víctimas de delitos sexuales fueron menores de edad (Ministerio del Interior, 2023), datos susceptibles de generar una gran alarma social. El presente estudio parte de tres muestras de delincuentes sexuales detenidos por los respectivos delitos de acoso sexual online a menores, el antiguo delito de abuso sexual (anterior a la reforma legislativa en España del año 2023) y el de pornografía infantil. Se pretendió valorar en qué medida las dos primeras utilizaron engaño y/o violencia física y verbal. También se tuvo en cuenta si el procedimiento utilizado por el delincuente (modus operandi) facilitó la actuación sobre un mayor número de personas. Se evaluó igualmente si los tres tipos delictivos analizados toman semejantes medidas de seguridad para evitar ser identificados, y si varía el medio a través del cual esos delitos son conocidos. Los resultados han mostrado que, lejos de confirmarse la hipótesis sobre el uso habitual del engaño por parte de los acosadores sexuales online de menores, éstos no siempre utilizan este medio comisivo. Además, no sólo son capaces de ejercer violencia y engaño de forma más habitual que los abusadores sexuales de menores, sino también de combinar ambas para la eficaz consumación de sus acciones criminales. Por último, cabe destacar que los resultados pueden verse mediatizados por el evidente origen distinto de la noticia criminal según el delito concreto investigado.
