Take it Down Act: un análisis crítico de su rol contra la difusión no consentida de imágenes y deepfakes

El presente artículo tiene por objetivo analizar de manera crítica los mecanismos clave, las fortalezas y los desafíos de la Take it Down Act, promulgada en Estados Unidos para combatir la proliferación de representaciones visuales íntimas no consentidas, incluyendo los deepfakes, y evaluar su equilibrio entre la protección de las víctimas y la salvaguarda de derechos fundamentales. Se empleó una metodología cualitativa, centrada en el análisis documental especializado. Esto incluyó un examen sistemático-lógico del texto íntegro de la ley y una revisión de la literatura académica y especializada para contextualizarla e identificar debates doctrinales y jurisprudenciales relevantes. Como resultados, se plantea que, si bien la Take it Down Act introduce avances significativos, en la práctica los mecanismos de la ley pueden generar tensiones con derechos fundamentales como la libertad de expresión y el debido proceso. Se identifican cargas operativas significativas para las plataformas, desafíos relacionados con la jurisdicción global de internet y la capacidad de supervisión de la Comisión Federal de Comercio. Por último, se concluye que, no obstante, su éxito a largo plazo y su aplicación equitativa dependerán de una implementación cuidadosa, una supervisión diligente por parte de la Comisión Federal de Comercio y una disposición a la adaptación continua frente a la evolución tecnológica y los desafíos interpretativos.
